Terms and Conditions

Welcome to PetCalendar.com (“PetCalendar,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile experience, and services (collectively, the “Site”), including the creation and purchase of customized calendars and related products (the “Products”). By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy (collectively, the “Agreement”).
If you do not agree, do not use the Site.
1) Eligibility & Accounts
- Eligibility. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site and place orders.
- Account. You may create an account to save designs and order history. You’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at patrick@petcalendar.com of any unauthorized use.
2) Changes to the Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where required by law, provide additional notice. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
3) Personalization, User Content & License
- User Content. Our products can be customized with photographs, text, and other content you upload (“User Content”). You represent and warrant that you own or have all necessary rights, licenses, and permissions to use and print the User Content, and that printing it will not infringe any third-party rights (including copyrights, trademarks, rights of publicity or privacy).
- Content Standards. You agree not to upload content that is illegal; hateful; harassing; defamatory; obscene; sexually explicit; exploits or harms minors; promotes violence or self-harm; or violates others’ rights, including images you do not own or do not have permission to use. We may (but have no obligation to) review, refuse, or remove User Content at any time at our sole discretion.
- License to Us. Solely for the purposes of providing the Site and fulfilling your orders, you grant PetCalendar a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., for sizing/cropping/print preparation), and print your User Content. We do not sell or license your User Content to others.
- Retention. We may retain User Content, design previews, and print files for a reasonable period to support reprints, customer support, and reorders (e.g., next year’s calendar). You can request deletion at patrick@petcalendar.com subject to legal/operational limits.
- Color & Cropping. On-screen previews are an approximation. Colors may vary due to device settings and print tolerances. Cropping may occur to ensure edge-to-edge printing; keep important details away from edges and the top binding area (see Photo Guidelines).
4) Orders, Pricing & Payment
- Order Acceptance. Your order is an offer to buy the Products. We may accept or reject any order at our discretion (e.g., payment issues, suspected fraud, violation of content standards, out-of-stock).
- Pricing & Taxes. Prices are shown in U.S. dollars unless otherwise noted and are subject to change without notice. Applicable taxes and shipping charges will be calculated at checkout. You are responsible for any customs duties, import taxes, or fees for international shipments.
- Payment. We use third-party payment processors (e.g., Shopify Payments, PayPal). By submitting payment information, you authorize the charge for the total amount, including taxes, shipping, and any selected options.
- Promotions. Discounts, coupons, or promotions may have additional terms, limited quantities, or expiration dates. We reserve the right to modify or cancel promotions at any time.
- Errors. We strive for accuracy but may occasionally have pricing, availability, or typographical errors. We reserve the right to correct these and to cancel orders affected by such errors, with a full refund.
5) Production & Shipping
- Made to Order. Most Products are custom printed on demand. Production typically takes 2-5 business days, but times may vary during peak seasons or due to capacity or carrier issues.
- Fulfillment Partners. We use third-party manufacturing and logistics partners (including Gelato) for local production and delivery. Your order may ship from different facilities and in multiple packages.
- Shipping Estimates. Transit estimates shown at checkout are estimates only and not guaranteed. Risk of loss passes to you upon our delivery to the carrier. Title passes upon payment and acceptance of the order.
- Addresses. Please verify shipping addresses carefully. We are not responsible for delays or losses due to incorrect or incomplete addresses. If a package is returned to sender, we can reship (additional shipping charges may apply).
6) Approval, Changes & Cancellations
- Proofing. You are responsible for reviewing your design in the Personalization Studio prior to checkout (including images, cropping, captions, and dates).
- Changes/Cancellations. Because custom items move quickly into production, changes or cancellations may not be possible after the order is placed. If you need help, contact patrick@petcalendar.com immediately. If the order has not entered production, we’ll do our best to accommodate.
7) Returns, Reprints & Problems with Your Order
- Custom Products Are Final Sale. Personalized items are made just for you and are not returnable for buyer’s remorse, formatting errors, or low-resolution images supplied by you.
- We’ll Make It Right for Defects. If your order arrives damaged, misprinted, or with manufacturing defects, contact patrick@petcalendar.com within 30 days of delivery with:
- Order number,
- Photos of the issue and the outer packaging, and
- A brief description.
Once verified, we will repair, reprint, or replace the item at no cost to you. - Wrong Address / Unclaimed. If an order is returned due to wrong or insufficient address, or unclaimed by the recipient, we can reship; additional shipping charges may apply.
8) Intellectual Property (Site Content)
- The Site, including text, graphics, logos, icons, images, software, and design elements (collectively, the “PetCalendar Content”) is owned by PetCalendar or its licensors and is protected by intellectual property laws.
- You may use the Site and PetCalendar Content only for your personal, non-commercial use in connection with shopping for and ordering Products. Any other use, including reproduction, modification, distribution, or reverse engineering, is prohibited without our prior written consent.
- Trademarks. “PetCalendar,” our logos, and trade dress are trademarks of PetCalendar. All other trademarks are the property of their respective owners.
9) Third-Party Services
The Site integrates with third parties (e.g., Shopify, Gelato, payment processors, analytics). Your use of those services may be subject to their terms and privacy policies. We are not responsible for third-party acts or omissions, but we select reputable providers and share only the data necessary to fulfill your order and operate the Site. 10) Prohibited Uses
You agree not to:
- Use the Site in any way that violates applicable law;
- Upload content that infringes third-party rights or our Content Standards (Section 3);
- Interfere with or disrupt the Site, servers, or networks;
- Use automated means (bots, scrapers) without our prior written permission;
- Misrepresent your identity or affiliation;
- Attempt to circumvent security or access non-public areas.
11) Copyright Complaints (DMCA)
If you believe content on the Site infringes your copyright, send a notice to patrick@petcalendar.com with:
- Your contact information;
- Identification of the copyrighted work;
- Identification of the allegedly infringing material and its location;
- A statement of good-faith belief;
- A statement, under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner’s behalf;
- Your physical or electronic signature.
We may remove or disable access to the material and, where appropriate, terminate repeat infringers’ accounts.
12) Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL PETCALENDAR OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations; these may not apply to you.
14) Indemnification
You agree to defend, indemnify, and hold harmless PetCalendar and our affiliates, officers, directors, employees, and agents from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Products; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement of any third-party right.
15) Governing Law & Dispute Resolution
- Governing Law. These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-laws rules.
- Venue. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Lane County, Oregon for any dispute not subject to arbitration below.
- Informal Resolution. Before filing a claim, you agree to contact us at patrick@petcalendar.com and attempt to resolve the dispute informally for at least 30 days.
- Arbitration. Any dispute arising out of or relating to this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. BY AGREEING TO ARBITRATION, YOU WAIVE THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. The seat of arbitration shall be Eugene, Oregon. Each party bears its own fees and costs unless the arbitrator awards otherwise under applicable law.
16) Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any conduct we believe violates these Terms, applicable law, or is otherwise harmful to the Site, customers, or third parties.
17) Force Majeure
We are not liable for any delay or failure to perform due to events beyond our reasonable control, including acts of God, labor disputes, supply shortages, war, terrorism, pandemics, utility failures, or governmental actions.
18) Miscellaneous
- Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and PetCalendar regarding the Site and Products.
- Severability. If any provision is found unenforceable, the remaining provisions remain in full force.
- No Waiver. Our failure to enforce any provision is not a waiver of our rights.
- Assignment. You may not assign any rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Electronic Communications. You consent to receive communications electronically. Keep your contact details current.
